1. Payment Terms

All payments are due immediately upon request or issue of invoice unless otherwise agreed in writing.
Failure to make payment when due constitutes a breach of contract.

2. Deposits

A deposit is required to commence sourcing, inspection, or auction bidding.

All deposits and stage payments become non-refundable once a vehicle has been secured, purchased, or committed to on the buyer’s behalf.

Deposits secure auction bidding, vehicle purchases, and associated services.

3. Commitment to Purchase

Payment of the first instalment constitutes a binding commitment to complete the purchase in full under these Terms.

4. Pricing & Exclusions

Quoted prices include only those costs expressly stated in the written quotation.

VRT and any statutory charges not specifically listed in writing are excluded.

5. Additional Costs & Late Payment

If any balance is not paid when due, the buyer remains fully liable for all additional costs arising from the delay. This includes, but is not limited to:

  • Storage charges
  • Demurrage
  • Port or handling charges
  • Currency losses
  • Administrative fees
  • Third-party penalties

All outstanding amounts must be settled prior to release of the vehicle.

6. Buyer Default

If the buyer fails to complete payment, JDM Moto Imports reserves the right to:

  • Retain all deposits paid
  • Cancel the order
  • Resell the vehicle
  • Recover any shortfall and all associated losses arising from the buyer’s default

7. Vehicle Condition

All vehicles are pre-owned and may show signs of age and use.

Vehicles are supplied based on auction sheets, seller descriptions, and inspection reports.

All vehicles are sold as seen.

8. No Warranty

All vehicles are sold without warranty, express or implied.

JDM Moto Imports shall not be liable for mechanical or electrical faults, wear and tear, or failures arising after purchase or delivery.

9. Delivery & Timeframes

All delivery dates are estimates only and not guaranteed.

Delays due to shipping schedules, customs clearance, port congestion, inspections, strikes, or circumstances beyond our control shall not entitle the buyer to cancellation or refund.

10. Force Majeure

JDM Moto Imports shall not be liable for delay or failure to perform due to events beyond its reasonable control.

11. Governing Law

These Terms are governed by the laws of Ireland.
Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

12. Deposit Refund Clarification

Deposits are fully refundable only where no sourcing, inspection, or bidding work has been undertaken.

Where work has been carried out and the buyer elects not to proceed, part or all of the deposit may be retained to cover incurred costs.

If continuing with a purchase, the deposit may be transferred to another target vehicle where applicable.
